Heard learned counsel for the parties.

The Petitioner is an accused in G.R. Case No. 137 of 2019, arising out of Nuagaon P.S. Case No. 206 of 2019 on the file of learned ADJ-cum-Special Court under POCSO Act, Berhampur, for the alleged commission of offence under Sections 376-AB of the I.P.C. and Sec. 6 of the POCSO Act. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned ADJ-cum-Special Court under POCSO Act, Berhampur by order dated 13.07.2021, in the aforementioned case, the present BLAPL has been filed. 5.

Considering the statement of the victim which is on record and of the witness who is none other than her maternal

grandmother, this Court is not inclined to enter this application under Section 439 Cr.P.C. at this stage.

Accordingly, the BLAPL stands dismissed.
