This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in Special G.R Case No.73 of 2022, pending on the file of Addl. Sessions Judge-cum-Special Court under POCSO Act, Cuttack, arising out of Jagatpur P.S Case No.215 of 2022, for commission of the alleged offence under Section 376(1)/354-C/354-D/506/509 IPC and Sections 66-C/66E/67 of the I.T Act and Sections 4/12/14(1) of the POCSO Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Special Court under POCSO Act, Cuttack by order dated 07.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since 26.05.2022 and as the charge sheet has been filed on 25.07.2022, his further continuance in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail. 7.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Considering the tenor thereof, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
