1. By the impugned order dated 22nd July 2019, learned Single Judge has disposed of W.P.(C) No.4357 of 2010 filed by the Respondent No.3 herein relying on an order dated 25th April, 2019 in W.P.(C) No.2144 of 2010 and that order has already been set aside by this Court by the judgment dated 26th October, 2021 in W.A. No.379 of 2019 (Governing Body of Ananda Sahu Women's College, Nayagarh v. State of Odisha).

2. In that view of the matter, the impugned order dated 22nd July, 2019 is hereby set aside. W.P.(C) No.4357 of 2010 is restored to the file of learned Single Judge in the roster Bench to be proceeded with on merits. The said writ petition will now be listed for directions on 4th January, 2023.

3. Since this order has been passed in absence of Respondent No.3 (Writ Petitioner), learned Single Judge will proceed after issuing notice to the Petitioner to appear. Meanwhile, learned counsel for the present Appellant will also intimate the Writ Petitioner to remain present before the learned Single Judge on the aforementioned date.
