The petitioner has surrendered to custody on expiry of the period of interim bail.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody in connection with Bhubaneswar P.S. Case No. 28 of 2020 corresponding to Special Case No. 299 of 2020 pending in the court of learned 2nd Additional Sessions Judge, Balasore for the alleged commission of offence under Section 21(C)/29 of NDPS Act.

Considering the fact that the seized contraband is more than commercial quantity weighing 1 kg. of brown sugar, I am not inclined to grant bail to the petitioner. However, having regard to the fact that he has been in custody for more than 2 years and trial is yet to be concluded, I am inclined to take a lenient view by directing learned court below to release the petitioner on interim bail for a period of two weeks as also to make efforts to conclude

the trial as early as possible.
