This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for both the Parties.

The present Writ Petition has been filed with the following prayer:- "(i). Direct the opp. parties to implement the order dt. 27.03.2012 in O.A. No.169(C) / 2009 passed the learned Tribunal in favour of the petitioner and grant the benefit of pay protection as has been given to similarly situated persons viz- Padmolochan Kalia, Judhistir Raj and others in terms of the decision in O.a.

No.2250(C) /2004 and O.A. No.1766(C)/2003, which has been affirmed by this Hon'ble Court in W.P.(C) No.22327/2013 vide order dated 21.03.2017 and also be the Hon'ble Supreme Court in SLP(C) Diary No.40571 / 2017 vide order dtd.19.01.2018 as at Annexure-3 & 4 within a stipulated period and grant pension and pensionary benefits accordingly.

Taking into account the nature of claim made in the Writ Petition and the prayer made by the learned counsel for the Petitioner, the Petitioner is permitted to make a representation

// 2 // before Opp. Party No.1 within a period of 15(fifteen) days from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No. 1 in accordance with law and also taking into account the order passed under Anenxures-2 &

5. The entire exercise shall be completed within a period of 3(Three) months from the date of receipt of such representation. 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
