This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.733 of 2022, pending before the S.D.J.M., Deogarh, arising out of Deogarh P.S. Case No.462 of 2022, for offences under Sections 420/409 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Deogarh, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that co-accused Binod Kumar Nag has already been released on anticipatory bail by order dated 20.09.2022 in ABLAPL No.7401 of 2022. Hence, inter alia on the ground the petitioner seeks release. 6.
Learned counsel for the State on the basis of recitals in the Case Diary submits that an amount of Rs.8,52,034/-(Rupees eight
lakh fifty two thousand thirty four) has been transferred to the account of the present petitioner.

Considering the nature of allegations and the role ascribed to the petitioner and the conditions prescribed while releasing the said Binod Kumar Nag, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall deposit an amount of Rs.2,50,000/-(Rupees two lakh fifty thousand) by way of cash security which shall be kept in a short term interest bearing account pledged in the name of the Court and subject to the final outcome.

It is further directed the petitioner shall appear before the Investigating Officer once every week till conclusion of trial. 10.
Accordingly, the BLAPL stands disposed of.
