1. This is an application under Sec.439 Cr.P.C. for bail.

2. Heard Mr. R. Rath, learned counsel for the Petitioner as well as Mr. A. Rath, learned A.S.C. for the State-Opposite Party.

3. It appears in course of hearing that the present Petitioner had earlier approached this Court in BLAPL No.10917 of 2019 which was dismissed for non-prosecution on 24.11.2020 and thereafter CRLMA No.168 of 2020 was filed on 14.12.2020. During pendency of the said CRLMA, the present bail application was filed on 26.07.2021 without mentioning about the pendency of the said CRLMA.

4. Accordingly, the present bail application is dismissed considering the pendency of the CRLMA.
