This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.227 of 2022, on the files of learned J.M.F.C. Aul, arising out of Rajaknika P.S. Case No.108 of 2022, under Section 420 of IPC and he is in custody since 09.04.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kendrapara, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State submits that charge sheet is filed on 31.05.2022.

Learned counsel for the petitioner submits that in view of filing of charge sheet further continuance of the petitioner in custody is not warranted and considering his age, he should be released on bail.

On instruction the learned counsel for the State submits that an amount of Rs.1,80,700/- (Rupees One Lakh Eighty Thousands Seven Hundreds only) has been transferred to the account of the petitioner.

Taking into account the period of custody and filing of charge sheet, this Court directs the petitioner to be released on bail. The learned Court in seisin to fix the terms. Additionally it is directed that petitioner shall submit cash security to the tune of Rs.1,00,000/- (Rupees One Lakh only) which shall be in the name of the Court in seisin over the matter and shall abide by the final result.

Accordingly, the BLAPL stands disposed of.
