Learned counsel for the Petitioner wants to withdraw the Writ Petition with liberty to the Petitioner to file Appeal. Consequently, the Writ Petition stands dismissed as withdrawn with liberty as prayed for. 2.

It may be open to the Petitioner to take the ground of encroachment involving other family members for consideration of the Appellate Authority. This Court observes in the event, the Petitioner is in occupation of property while permitting the Petitioner to file Appeal within a period of two weeks directs the Appellate Authority to conclude the same within six weeks. The interim application shall be disposed of within a period of four weeks. Status quo involving the dispute property shall be maintained within a period of eight weeks. (Biswanath Rath) Judge Swarna
