This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 147,148,332,353,294,506,342,431,427,435,307,338,337, 269,270,188,149, I.P.C. read with Sections 3 & 4 of Prevention of Damage to Public Property Act 1984, Section 3 of Epidemic Diseases Act, 1897 and Section 51 of Disaster Management Act, 2005. Perused the copy of the F.I.R.

Considering the nature of accusation against the Petitioner and the fact that the co-accused persons have already been granted anticipatory bail by this Court in different Bail Applications, and the background of the case, the period when the alleged offences took place and on hearing learned counsel for the State, I am inclined to
// 2 // release the Petitioner on anticipatory bail, and accordingly this Court directs that in the event of arrest of the Petitioner in connection with Tirtol P.S. Case No.212 of 2020 corresponding to G.R. Case No.206 of 2020 pending in the Court of learned J.M.F.C., Tirtol, he shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties each for the like amount to the satisfaction of the Arresting Officer, with the further conditions that the Petitioner shall make himself available for interrogation by the I.O. as and when required, and he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Investigating Officer. Violation of any of the above conditions shall entail cancellation of bail. 5.
The ABLAPL is disposed of accordingly.
