The matter is taken up through hybrid mode.

Heard Mr. A.K. Rout, learned counsel for the Petitioner and Mr. K.K. Das, learned Additional Standing Counsel. 3.

This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Raghu Hantal in connection with Machhakund P.S. Case No.54 of 2021 corresponding to T.R. Case No.56 of 2021 pending in the court of learned Additional Sessions Judge-cumSpecial Judge, Koraput for alleged commission of offence under Sections 20(b)(ii)(c)/29 of N.D.P.S. Act for alleged possession of contraband ganja weighing about 101 kg. 500 grams. 4.

It is submitted that the Petitioner is no way connected with the contraband seized from the Innova Car and admittedly he was the rider of the motor cycle which allegedly escorting the Innova Car. 5.

After hearing Mr. Das, learned Additional Standing Counsel for State and considering the circumstances of the case where the specific

allegation is to the effect that the Petitioner being the rider of the motor cycle was piloting the Innova Car transporting contraband ganja up-to the quantity of 101 kg. 500 grams that attracts commercial quantity, and keeping in view the embargo contained under Section 37(1)(b) of NDPS Act, I am not inclined to release the Petitioner on bail. Accordingly, his prayer for bail is rejected. 6.
