ORDER

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This interlocutory application has been filed by the Petitioner seeking modification of the condition imposed in paragraph-8 of order dated 29.07.2022 passed by this Court in the aforesaid bail application.

It is submitted by the learned counsel for the Petitioner that the injured sustained by the injured is grievous one. However, the injury is not caused on head. It is further submitted that co-accused persons similarly situated with the present Petitioner has already been released on bail by the court below.

Considering such submission, the condition imposed in paragraph-8 of the aforesaid order dated 29.07.2022 is waived. However, the following conditions be added:- (i) Petitioner shall furnish cash security of Rs.3,000/-

// 2 // (Rupees three thousand) in the name of the Court in seisin over the matter which shall be kept in an interest bearing account of the Nationalized Bank and the same shall be subject to the final outcome of the trial; and (ii) he shall appear before the Police Station concerned once in a fortnight in between 10.00 A.M. to 1.00 P.M. till conclusion of the trial.

So far as the extension of time to surrender of the Petitioner before the Court in seisin over the matter is concerned, the time to surrender of the Petitioner is extended to another four weeks from today subject to deposit of a sum of Rs.500/- (Rupees five hundred) in the Advocates' Welfare Fund of the Orissa High Court Bar Association within fifteen days hence and furnishing money receipt thereof in proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the Petitioner to surrender shall stand revoked automatically.

Rest part of the said order dated 29.07.2022 remains unaltered. 8.

I.A. is disposed of accordingly.

Issue urgent certified copy as per rules.
