This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.1731 of 2022, arising out of Jharsuguda P.S. Case No.143 of 2022 pending in the court of learned S.D.J.M., Jharsuguda for commission of offence punishable under Sections 147/148/341/ 323/307/427/336/506/149, I.P.C.

Learned counsel for the petitioner submits that the allegations made against the petitioner are false and baseless and the petitioner is no way connected with the alleged offences. The petitioner is innocent and no way involved in any offence as alleged by the informant.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrender before the learned S.D.J.M., Jharsuguda in the aforesaid case within a period of three weeks from today and move for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate with further condition that the petitioner shall not disturb the peace and tranquility and shall not instigate other employees. 7.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
