None appears for the petitioner, when the matter is called. 3.

It is submitted by Mrs. Saswata Pattnaik, learned Addl. Government Advocate that the victim girl was rescued by the I.I.C., Begunia Police Station and her statement was recorded under Sections- 161 & 164 Cr. P.C.

It is submitted that the victim stated before the Police as well as the Magistrate that, she is aged about 19 years old and she wants to live with her husband, who is alleged to have kidnapped her. In her own volition, therefore, the victim was left in the company of the

accused and the Final Form has been filed treating the case as mistake of fact in as much as the victim has attended majority on the date of her rescue.

In view of such fact, noting remains to be decided in the WPCRL and the WPCRL is accordingly disposed of. ...............................
