This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special(N.D.P.S.) Case No.26 of 2022, on the files of learned Sessions Judge-cum-Special Judge, Boudh, arising out of Baunsuni P.S. Case No.53 of 2022, under Sections 20(b)(ii)(B) of N.D.P.S. Act and is in custody since 26.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Boudh, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Considering the quantity of contraband seized which is admittedly less than commercial quantity and the petitioner is a
local person, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that he shall appear before the jurisdictional Police Station once in every week. First date of such appearance be fixed by the learned Court.

Accordingly, the BLAPL stands disposed of.
