Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.2836 of 2022, pending in the file of learned S.D.J.M., Bhubaneswar, arising out of Mancheswar P.S. Case No.146 of 2022, for commission of alleged offences under Sections 420/294/506 of IPC and is in custody since 11.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 4th Additional Sessions Judge, Bhubaneswar by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioner is in custody since 11.05.2022 and charge sheet has already been filed on 30.05.2022 and keeping in view the allegations further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail.

It is submitted by the learned counsel for the State on the basis of materials on record that there are clinching evidence to show that the petitioner has taken an amounts Rs.3,47,500/- on different dates including cash to the tume of Rs.92,000/-. 7.
Considering the nature of allegations and the age of the petitioner and that the charge sheet has already been filed, this Court directs the petitioner to be released on bail on such terms to be fixed y the learned Court in seisin.

Additionally, it is directed that the petitioner shall furnish cash security to the tune of Rs.50,000/- (Rs. Fifty Thousand) only which shall be kept in short terms interest bearing account pledged in the name of Court in seisin and shall abide by the result thereof and also shall furnish property security for an amount of Rs.3 lakh (Rupees Three Lakh).

Accordingly, the BLAPL stands disposed of.
