This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.117 of 2021, on the files of learned J.M.F.C., Salipur, arising out of Mahanga P.S. Case No.35 of 2021, under Sections 302 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the Additional District & Sessions Judge, Salipur, by order dated 14.07.2021 in the aforementioned case, the present BLAPL has been filed.

Taking note of submissions of the learned counsel for the petitioner that the accusation is based on circumstantial evidence and the confessional statement of the petitioner, as noted in the order of rejection by the learned Sessions Judge, this Court directs

the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter.

Accordingly, the BLAPL stands disposed of.
