The matter is taken up through virtual mode.

Heard Mr. J.R. Deo, learned counsel for the Appellant and Mr. D.C. Dey, learned counsel for the claimant - Respondent No.1. 3.

It is submitted that against the common judgment of this court dated 22nd August, 2022, the insurer as well as the claimants have moved Hon'ble Apex Court in SLP (Civil) No.3900 to 3904 of 2023 and 3906 to 3909 of 2023 respectively. All such special leave petitions filed by both parties have been dismissed by order dated 21st February, 2023. In the process, the compensation amount could not be deposited in time as per direction of this court.

It is accordingly prayed that further two months time may be extended in favour of the insurer to deposit the award amount and till then the direction for payment of penal interest may be waived. 4.

Upon hearing both parties and considering the submissions, the direction for payment of penal interest is waived till 20th June, 2023, subject to deposit of the award amount with interest within said period.
