Mr. Manoranjan Padhy, learned counsel for the petitioner submits that though he has filed this I.A. for withdrawal of the BLAPL filed for interim bail with liberty to file regular bail application before the trial court, he does not want to press the I.A. and wants to argue the bail application on merit. Hence, the I.A. is dismissed, as not pressed. ...........................

(Savitri Ratho) Judge BLAPL No.5892 of 2021 This bail application has been filed with a prayer to release the petitioner- Brajendra Brahma @ Muna on interim bail. Perusal of the impugned order dated 21.07.2021 reveals that Smt. Meenathi Brahma @ Surabhi Brahma, wife of the petitioner had undergone open heart surgery in the year 2001 and since her

// 2 // surgery, she is going to Appolo Hospital, Visakhapatnam for regular check up in every three months and there is nobody in his family to take her to Visakhapatnam for medical checkup. Hence, the petitioner prayed for release him on interim bail for a period of two months to take his wife for medical checkup.

As prayer before the learned court below was also for interim bail only, the BLAPL is disposed of granting liberty to the petitioner to move for regular bail before the learned court below, if so advised.

Urgent certified copy of this order be granted on proper application.
