2. Heard Mr. S.N. Nayak, learned Additional Standing Counsel for the State and learned counsel for the opposite party. 3.

The State-petitioner has filed this writ petition challenging the order dated 08.04.2013 passed by Orissa Administrative Tribunal, Bhubaneswar in O.A. No. 79 of 2004.

On perusal of the record, it reveals that the order of the Tribunal was passed on 08.04.2013 and the State-petitioner has filed this writ petition only on 02.03.2016, i.e. after about three years of the order passed by the tribunal. Therefore, this writ petition suffers from delay and laches in view of the judgment/order of this Court in the case of State of Odisha v. Surama Manjari Das (W.P.(C) No. 15763 of 2021 dismissed on 16.07.2021).
