This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T. Case No.27 of 2021 corresponding to G.R. Case No.680 of 2020, pending before the learned Additional Sessions Judge, Malkangiri, arising out of Mudulipada P.S. Case 27 of 2020, for alleged commission of offences under Sections 302/201 of IPC and Section 4 of the Odisha Prevention of Witch Hunting Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Malkangiri, by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed.

Considering the statement of the witnesses, Buja Sisa and Buja Kirsani, this Court is not inclined to entertain this bail application of the petitioner at this stage.

It shall be open to the petitioner to move the learned Court in seisin over the matter afresh, after examination of the above two witnesses.

Accordingly, the BLAPL stands disposed of.
