This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.3133 of 2022, on the files of learned S.D.J.M., Bhubaneswar, arising out of Cyber Crime and Economic offences P.S. Case No.20 of 2022, under Sections 419/420/467/468/34 of I.P.C. read with Sections 66(C)/66(D) of I.T. Act and is in custody since 26.05.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3rd Additional Sessions Judge, Bhubaneswar, by order dated 16.07.2022 in the aforementioned case, the present BLAPL has been filed.

The allegation against the petitioner is that he duped the informant and defrauded him of Rs.78,000/-. Learned counsel for the petitioner submits that in fact he has deposited the amount in the

Helpingparivar.com account and as such he is himself a victim and therefore seeks his release on bail.

Taking into account the nature of allegations and manner in which the alleged offences stated to have been committed and the role played by the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall deposit cash security to the tune of Rs.30,000/- (Rupees Thirty Thousands only) it shall be kept in interest bearing account pleaded to Court in seisin subject to the outcome of the trial.

Accordingly, the BLAPL stands disposed of.
