This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T. Case No.62 of 2022, pending before the learned Additional Sessions Judge-cum-Special Judge, Koraput, arising out of Koraput Town P.S. Case 324 of 2021, for alleged commission of offences under Sections 302/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Koraput, by order dated 28.06.2022 in the aforementioned case, the present BLAPL has been filed.

Considering the statement of one of the witnesses, Maina Muduli coupled with the statement of disclosure under Section 27
of the Evidence Act, this Court is not inclined to entertain this bail application of the petitioner at this stage.

It shall be open to the petitioner to move the learned Court in seisin over the matter afresh, after examination of material witnesses.
7.
Accordingly, the BLAPL stands disposed of.
