BLAPL No.5899 of 2021 Arakhita @ Arakshita Moharana ....

Petitioner Mr. S.C.Mohanty, Advocate -versusState of Orissa ....

Opp. Party M/s. P.K.Patnaik, A.G.A.

Mr.T.K.Mishra, Advocate for informant.

CORAM:

JUSTICE G. SATAPATHY Order No.

ORDER

02.11.2022 I.A. No. 1919 of 2022 07.

1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2.

The present I.A. has been filed by the petitioner seeking interim bail to him for a period of three months.

3.

Learned counsel for the petitioner submits to grant interim bail to the petitioner. On the other hand, learned counsel for the informant opposes such prayer of the petitioner. Learned counsel for the State also opposes the interim bail prayer of the petitioner in vehemence. 4.

Considering the rival submissions and taking into consideration the averments in the Interlocutory Application and regard being had to the fact that no document has been filed in support of the illness of the patient, this Court does not find any justification to grant interim bail to the petitioner. 5.

Hence, the I.A. is dismissed.

( G. Satapathy) Judge Kishore 08.

BLAPL NO. 5899 of 2021 1.

In course of hearing of bail application, learned counsel for the petitioner seeks permission of the Court to withdraw the bail application.

// 2 // 2.

Learned counsel for the informant and learned counsel for the State are present.

3.

In view of the aforesaid submissions, the BLAPL is disposed of as withdrawn.

( G. Satapathy) Judge
