Heard learned counsel appearing for the petitioners. 2.
For the submission of learned counsel appearing for the petitioners that there is already availability of a notice to some of the petitioners included herein vide Annexure-4 not only that after providing opportunity of hearing before taking the decision in the matter of new revenue village, it appears, there is already filing of objection even vide Annexure-5. It is at this stage of the matter, Mr. Das, learned counsel appearing for the petitioners expresses anxiety submitting that the public authority is determined to go for the new revenue village. In the situation involved herein, a notice being issued to the villagers particularly, the petitioners and objection having been filed, it cannot be expected that the Collector still passes order without considering the objection of the petitioners. If at all such a objection is there through Annexure-5 already available with the Collector, Nayagarh, this Court finds grievance of the petitioners becomes premature. In the process, the writ petition is not entertainable which is rejected accordingly.
