This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioners for anticipatory bail.

It is submitted by the learned counsel for the Petitioners that the principal accused Anil Kumar Sahoo has been released on bail by this Court in BLAPL No.6295 of 2022 vide order dated 26.07.2022. So far as the Present Petitioners are concerned, it is stated that the Petitioner No.1 is the mother of the principal accused and Petitioner Nos. 2 & 3 are co-villagers. He further submits that the Petitioners have no specific role in the alleged crime. They have also not been named in the F.I.R. However, they are apprehending their arrest. 5.

Considering the nature of allegations made, gravity of the

// 2 // offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioners. However, it is directed that in the event the Petitioners surrender before the learned Additional Sessions Judge-cum-Special Court under POCSO Act, Cuttack in Spl G.R.Case No.77 of 2022 arising out of Kanpur P.S.Case No.79 of 2022 within a period of three weeks from today and move for bail, they shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate. 6.

The ABLAPL is accordingly disposed of.
