For the disputed question of fact and as there is already Order No.
determination of the Petitioners as encroachers in Encroachment Case No.1440/2021, this Court finds, the writ petition is not entertainable at this stage.

The writ petition is, accordingly, dismissed. It is, however, made clear that if the Petitioners are so advised, may avail appropriate remedy involving the issue involved herein.
