This matter is taken up through hybrid mode.

Heard Mr. A. Patnaik, learned for the Petitioner and Mr. A. K. Mishra, learned Additional Government Advocate. 3.

The Petitioner has filed this Writ Petition seeking to quash the Order dated 25.08.2021 passed in T.M.C. No. 03/2015-16 to 2019-20 and further seeks to quash the Demand letters dated 14.09.2021 and 19.04.2022 vide Annexure-7 and 11 respectively, and to issue direction to the opposite parties to conduct-remeasurement of the aforesaid sand quarry as per the request letter dated 29.10.2021 under Annexure-8, within a stipulated time.

In course of hearing, learned Counsel for the Petitioner states that the Petitioner has already made representation before the Opposite Party No.3 vide Annexure-8 and the same may be directed to be disposed of within a stipulated time taking into consideration Annexure-9, to which learned Counsel for the State has raised no objection.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.3 to consider and dispose of the representation filed by the Petitioner vide Annexure-8 taking into consideration Annexure-9 and pass appropriate in accordance with law, as early as possible preferably within a period of three months from the date of production of certified copy of this Order.
