This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with T.R. Case No. 13 of 2020 arising out of Papadahandi P.S. Case No. 109 of 2020, pending on the file of the learned Sessions Judge-cumSpecial Judge, Nabarangpur, for the alleged commission of offence under Sections 20(b)(ii)(c) of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail under Sec. 439 Cr.P.C. by the learned Sessions Judge-cumSpecial Judge, Nabarangpur, by order dated 6.08.2022, in Bail, the present BLAPL has been filed.

Perused the rejection order. It is seen that the learned Special Judge has considered the bail application of the petitioner during the curse of investigation.

This Court is not persuaded to consider the bail application during the pendency of investigation keeping in view that the quantity of contraband is to the tune of 5 Quintals 836 Grams (Ganja) 7.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered on its own merit without being influenced by the earlier order of rejection or the order passed by this Court.

The Bail Application thus, stands disposed of. 9.

Urgent certified copy of this order be granted as per rules.
