Heard Mr. Anshuman Ray, learned counsel for the petitioner and Mr. P.K. Mohanty, learned Addl. Standing Counsel for the State.

This is an application in connection with Bhadrak Rural P.S. Case No.234 of 2021 corresponding to Special (NDPS) Case No.69 of 2021 pending in the Court of learned Sessions Judge - cum- Special (NDPS) Judge, Bhadrak for commission of offence punishable under Sections 21(c)/29 of the NDPS Act read with Sections 27 and 28 of the Arms Act.

This I.A. has been filed for releasing the petitioner on interim bail on the ground that the petitioner is suffering from infections associated with earlier piles operation and the jail authorities are not taking proper care of his health. 5.

The petitioner is in custody in connection with the case registered under Section 21(C) of the NDPS Act read with Sections 28 of the Arms Act. The forwarding report indicates that the

// 2 // petitioner has six criminal antecedents including the offence under Sections 392/307 of the IPC and another case under the NDPS Act. 6.

Considering the submissions and the nature of allegations against the petitioner and his criminal antecedents, neither I am inclined to release the petitioner on interim bail nor regular bail at this stage.

Hence the prayer for Interim bail and regular bail are rejected.

The I.A. and BLAPL are accordingly dismissed. .........................
