ORDER

Order No.

16.08.2022 2.

1.

This matter is taken up through hybrid mode.

2.

The Petitioner in this writ petition seeks to assail the order dated 8th July, 2022 (Annexure-8) passed by learned Judge, Family Court, Baripada in C.P. No. 611 (T) of 2018, whereby he rejected an application filed by the Petitioner under Order XI Rule 12 read with Section 151 C.P.C. with a prayer to direct the Opposite PartyHusband to submit the monthly income certificate and bank account statement, which were under his custody.

3.

Considering the submission made by learned counsel for the Petitioner, this Court vide order dated 26th July, 2022 called for a report from learned Judge, Family Court, Baripada with regard to the status of the petition dated 25th January, 2022. Although it is stated that said petition could not be taken up for consideration, but holding that the entire arrear maintenance has been paid to the Petitioner, learned Judge, Family Court, Baripada opined that said petition has become infructuous. It further reveals from the report

// 2 // that C.P. No.611 (T) of 2018 has already been disposed of vide judgment dated 28th July, 2022.

4.

In view of the above, nothing remains to be adjudicated in this writ petition, which is accordingly disposed of as infructuous. Urgent certified copy of this order be granted on proper application.
