This matter is taken up through Hybrid Mode.

None appears for the petitioner when the matter is called. 3.

The petitioner is an accused in connection with Baghamari P.S. Case No. 84 of 2022 corresponding to T.R. Case No. 61 of 2021, pending on the file of the learned 1st Addl. Sessions Judge-cum-Special Judge, under NDPS Act, Khurda, for commission of the alleged offence under Sections 21(b)/29 of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna (I/C) by order dated 29.06.2022, the present BLAPL has been filed.

On perusal of the order of rejection, it is seen that the investigation is going on and the petitioner is involved in similar

type of offences as noted by the learned Special Judge in the order of rejection. This Court is not inclined to entertain this bail application at this stage.

The BLAPL stands disposed of giving liberty to the petitioner to renew his prayer at an appropriate stage. 7.

In the event, fresh bail application is filed, the same shall considered by the learned court in seisin over the matter without being influenced by the earlier order of rejection or the order passed by this Court.
