This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with Spl.G.R. Case No. 97 of 2022 arising out of Kalimela P.S. Case No. 155 of 2022, pending on the file of the learned Sessions Judge-cumSpecial Judge, Malkangiri, for the alleged commission of offence under Sections 20(b)(ii)(c)/25 of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail under Sec. 439 Cr.P.C. by the learned Special Judge, Malkangiri (I/C), by order dated 17.06.2022, in Bail, the present BLAPL has been filed.

The consideration by the learned Court in seisin over the matter was during the course of investigation.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered on its own merit without being influenced by the earlier order of rejection or the order passed by this Court.

The Bail Application thus, stands disposed of. 8.
