This matter is taken up through hybrid mode.

This RPFAM has been filed assailing the judgment and order dated 18th May, 2017 passed by learned Judge, Family Court, Berhmapur in Criminal Proceeding No.24 of 2016 directing the Petitioner to pay a sum of Rs.6,000/- per month to Opposite Party No.1 and Rs.2,000/- per month to Opposite Party No.2 respectively with effect from the date of filing of application i.e. on 25th January, 2016.

The matter was taken up for hearing on 17th May, 2022, on which date on consent of learned counsel for the parties, this Court referred the matter to the High Court Mediation Centre for settlement of the dispute between the parties. Pursuant to the said order, mediation was taken up and the matter has been successfully mediated. Both the parties agreed as follows: "1.

The husband petitioner of this case namely, Simanchal Panda is agreed to pay an amount of Rs.9,00,000/- (Rupees Nine Lakh only towards permanent alimony of the wife opposite party namely, Gitanjali Panda and towards the care, education and also marriage expenditure of only

// 2 // daughter namely, Purnima Panda, aged about 19 years.

The husband petitioner will give the household things like wooden bed, steel almirah, sewing machine and one empty pedi (Box) to the wife opposite party. No more claim will be made by wife opposite party in future except the above. 3.

Both the parties agreed to be separated for ever by a decree of divorce on mutual consent by the concerned court of law. Accordingly, both the parties will approach the concerned court for divorce on mutual consent.

All the cases civil as well as criminal cases pending before the court of law in between them will be withdrawn/dropped after filing of mutual divorce petition and payment of initial amount of Rs.5,00,000/- (Five lakh only) by the petitionerhusband to the Opposite Party-wife out of total amount of Rs.9,00,000/-. The rest amount of Rs.4,00,000/- will be paid by the petitionerhusband on two equal instalments within a period of 15 months from the date of filling of mutual divorce petition."

Accordingly, learned Mediator submitted his report on 4th August, 2022.

Learned counsel for the parties submits that the RPFAM be disposed of in terms aforesaid settlement arrived between the parties.

Accordingly, the RPFAM is disposed of in terms of the settlement arrived between the parties before the Mediator. The parties are directed to adhere to the settlement arrived at before learned Mediator.

Urgent certified copy of this order be granted on proper application.
