This writ petition involves the following prayer:- "The petitioner, therefore, prays that your Lordships would be graciously pleased to admit this Writ Petition, call for the records and after hearing the parties allow the same, issue writ/writs in the nature of certiorari/mandamus and/or any other further writ/direction and direct the Tahasildar, Bhubaneswar to pass orders on the representation of the petitioner for allotment of a piece of Government land in Khata No.894, Plot No.161, Kissam- Patita for being use as a passage for ingress and egress of the petitioner to the public road."

Looking to the pleadings made in this writ petition, this Court finds, the Petitioner has already made a similar request to the Tahasildar, Bhubaneswar, which is claimed to be pending.

Considering the prayer made by the Petitioner and as a representation at the instance of the Petitioner on the selfsame issue is still pending before the Tahasildar, Bhubaneswar, this Court finds, the writ petition is premature at this stage. In the process, this Court directs the Tahasildar, Bhubaneswar to look into the request of the Petitioner vide Annexure-5 & 9 and take a lawful decision in the matter taking into account the grounds stated in this writ petition so also the documents appended thereto and also involving the Petitioner as well as the land owners in the locality likely to be affected.

The entire exercise shall be completed within a period of four months from the date of communication of an authenticated copy of this order along with a copy of the writ petition by the Petitioner.

The writ petition stands disposed of with the above order. 6.
Free copy of this order be handed over to the learned State Counsel for necessary communication.
