This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with C.T. Case No.129 of 2022 pending on the file of the learned J.M.F.C-cumG.N.A., Komna arising out of Komna P.S. Case No.129 of 2022 for commission of offence under Sections 364-A/34 IPC and Sections 25/27 of the Arms Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Nuapada by order dated 30.06.2022, the present BLAPL has been filed. 5.

Learned counsel for the Petitioner submits that the Petitioner is in custody since 02.06.2022 and the charge sheet has been filed on 30.09.2022 and since the Petitioner is the first offender, his case may be considered liberally.

Learned counsel for the State opposes the prayer for bail. 7.

Taking into account the period of custody and filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

While releasing the bail, learned Court in seisin shall verify the criminal antecedent of the Petitioner. If it comes to the fore that the Petitioner has any criminal antecedent, this order shall stand recalled.

The BLAPL thus stands disposed of.
