This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. (Special) Case No.37 of 2022, on the files of learned District & Session Judge, Bargarh arising out of Barpali P.S. Case No.185 of 2022, under Sections 21(b)/25/29 of the NDPS Act and is in custody since 12.06.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Bargarh, by order dated 13.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that co-accused have been released on bail by this Court by order dated 04.08.2022 in BLAPL No.6879 of 2022.

Taking into account the nature of allegation and the petitioner being in custody since 12.06.2022 and noting the submission of the learned counsel for the petitioner that he has no criminal proclivity, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While so releasing by the learned court in seisin over the matter to check the veracity of the submission of the learned counsel for the petitioner regarding the criminal proclivity. If it comes to the fore that the petitioner has any criminal proclivity, the present order shall stands recalled.

Additionally, it is directed that the petitioner shall appear in the jurisdictional Police station once every week till the submission of the Charge sheet.

Accordingly, the BLAPL stands disposed of.
