Heard learned counsel for the Parties.

This Court finds, there has been prior determination of the Petitioners as encroachers in the determination of the Encroachment Case No.94/86-87 appears to have been determined on 03.08.1993. 3.

Learned counsel for the Petitioners alleges that in spite of submission of an application for settlement of the disputed property vide Annexure-4, the proceeding has been concluded without considering such aspect.

This Court finds, several orders have already been passed holding that there is no possibility of repeated initiation of encroachment proceeding involving one encroacher. 5.

Petitioner at this stage of the matter seeks permission for not pressing the Writ Petition.

The Writ Petition is accordingly dismissed.
