It appears, the grounds raised herein can very well be agitated Order No.

in Misc. Case No.10 of 2022 for consideration of the Collector, Nuapada as the competent authority and the Collector has ample power to take a call on such issue under the provision of Section 26 of the Act. As a consequence, this Court finds, the writ petition is not entertainable at this stage. Accordingly, while dismissing the writ petition, this Court observes, dismissal of the writ petition shall not stand as a bar on the way of the Petitioner in raising all the grounds in the proceeding pending and getting it adjudicated. Petitioner, if so advised, may cite the judgment vide 2011(Supp.II)OLR 594 in order to strengthen her case.
