This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.664/63 of 2022 (POCSO), pending in the file of learned Additional Sessions Judge-cum-Special Court under POCSO Act, Bhawanipatna, arising out of Lanjigarh P.S. Case No.34 of 2022, under Section 354(C)/34 of IPC read with Section 12/14 of the POCSO Act along with Section 66(E)/67(A) of the I.T. Act and is in custody since 08.06.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Bhawanipatna by order dated 04.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioners submits that co-accused similarly circumstanced have been released on bail by this Court by order dated 12.08.2022 n BLAPL No.7011 of 2022 and by order dated 02.09.2022 in BLAPL No.7064 of 2022. Hence he seeks release of the petitioner.

Considering the nature of allegations, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
