Heard learned counsel for the petitioner and learned Additional Govt. Advocate for the State.

The petitioner had applied for the post of Anganwadi Worker of Pedipathar Anganwadi Centre under Athamallik Block in the district of Angul. She claims to be a permanent resident of the said village. In support of such claim, she has enclosed copies of the resident certificate under Annexure-3 series. A selection list was published on 21.06.2022 wherein, despite scoring the highest marks amongst all candidates, i.e., 89.71 %, the petitioner's candidature was rejected on the ground that she is "out of service area" and the opposite party no.5 was given appointment. The petitioner submitted an objection on 28.06.2022, which is enclosed as Annexure-4 to the writ petition to the Sub-Collector, Athamallik ventilating her grievance. It is submitted that the same is still pending.

Considering the fact that the petitioner's objection is required to be disposed of at the first instance by the SubCollector, the writ petition is disposed of with a direction to the Sub-Collector, Athamallik to consider the objection raised by the petitioner in her representation in accordance with law and to pass order thereon within a period of two weeks from the date of communication of this order or on production of certificate copy thereof by the petitioner. 5.

Till such time, any appointment made pursuant to the select list dated 21.06.2022 shall abide by the decision to be taken by the Sub-Collector on the representation so submitted by the petitioner.

Issue urgent certified copy as per rules.
