Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.49 of 2022, pending in the file of learned Additional District & Sessions Judge, Rayagada, arising out of Rayagada P.S. Case No.50 of 2022, offence under Section 302 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge, Rayagada, by order dated 14.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner seeks permission to withdraw this bail application to move the learned Court in seisin afresh, after examination of material witnesses. 6.
Giving such liberty, the BLAPL stands disposed of as withdrawn.

It is needless to state that if such an application is filed, the same shall be considered on its own merits.
