1. This matter is taken up through Hybrid mode.
2. Heard learned counsel for the petitioner.
3. This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 24.06.2022 passed by the learned J.M.F.C (R), Cuttack in ICC Case No.29 of 2021 wherein B.W has been issued against her.
4. It appears that since the Petitioner did not appear on 24.06.2022, B.W was issued against her vide the aforesaid order to procure her attendance. However, the Petitioner has come forward to challenge the same, but during course of hearing, it is submitted by the learned counsel for the Petitioner that the Petitioner is now ready and willing to surrender before the trial Court and cooperate with the trial
5. Considering the aforesaid facts and submissions made, this Criminal Misc. Case is disposed of with an order that if the
// 2 // Petitioner surrenders before the Court in seisin over the matter and moves for bail within six weeks hence, the Court in seisin over the matter shall allow her to go on bail on such terms and conditions as the learned Magistrate may deem just and proper including the condition that the Petitioner shall furnish an undertaking that she will cooperate with the trial. Failure on the part of the Petitioner to comply with the same shall entail cancellation of bail granted.
6.Till the aforesaid date, i.e. either the date of appearance before the trial court or on expiry of six weeks, whichever is earlier, the Petitioner shall not be arrested pursuant to the N.B.W.(A) issued.
7. Urgent certified copy of this order be granted on proper application.
