This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in S.T. Case No.15 of 2022 pending on the file of learned Addl. Sessions Judge, Khallikote, arising out of Rambha P.S. Case No.548 of 2022 for commission of offence under Sections 341/506/302/34 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Khallikote by order dated 13.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the Petitioner has been implicated on account of the statement of the co-accused K. Murali Reddy under Section 27 of the Evidence Act. It is stated that apart from the said statement, there are no other independent materials to connect the
Petitioner with the alleged crime. It is further submitted that A. Purushottam Reddy @ Kalia has since been released on bail by order dated 15.07.2022 in BLAPL No.2678 of 2022. 6.
Learned counsel for the State with usual fairness does not dispute the basis of implication and that the Petitioner is similarly circumstanced with A. Purushottam Reddy @ Kalia who has already been released on bail by this Court.

Considering the manner of implication and release of the co-accused, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
