This matter is taken up through Hybrid mode.

This CMP has been filed for a direction to learned Civil Judge (Senior Division), Kendrapada to dispose of CS No.215 of 2004/CS No.995 of 2013 pending before him at an early date.

Although on perusal of record, it appears that the Petitioner has taken a plea to the effect that pleadings are complete in the suit, but it does not give a clear picture about status of the suit. It is also not clear as to whether there is any legal impediment for disposal of the suit.

In view of the above, this Court is not inclined to grant the prayer as made in this CMP at this stage. However, the Petitioner is at liberty to move the learned trial Court for early disposal of the suit by filing an application stating the grounds therein after the suit becomes ready for hearing and in that event, learned trial Court may consider the said application in

// 2 // accordance with law and proceed with the matter accordingly. Parties are directed to cooperate learned trial Court. 5.

With the observation as aforesaid, the CMP is disposed of.

Issue urgent certified copy of the order on proper application.
