Heard learned for the petitioner and learned counsel for the State.

The petitioner is in custody in connection with Tamando P.S. Case No. 133 of 2020 corresponding to T.R. Case No. 403 of 2020 pending in the Court of learned 3rd Additional Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act.

This bail application was rejected earlier by this Court as per order passed in BLAPL No.10286 of 2021. In the meantime, one of the co-accused person standing on the same footing has been released on bail as per order passed by this Court in BLAPL No. 9587 of 2021.

Considering the above fact and the materials on record as also taking into account the long period of detention of the petitioner in custody without commencement of trial, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
