This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the parties.

The I.A. has been filed by the petitioner seeking modification of the order dated 01.08.2022.

It is submitted by learned counsel for the petitioner that the ABLAPL No.8758 of 2022 was disposed of by order dated 01.08.2022 granting anticipatory bail to the petitioner but in 7th line of paragraph-5 of the said order, it has been written subject to verification of criminal antecedents of similar nature. It is further submitted by learned counsel for the petitioner that at the time of surrender, the petitioner came to know that another criminal antecedent of similar nature is pending against the petitioner. Hence, modification has been prayed for.

Learned counsel for the State, on the other hand, opposes the prayer for modification of the petitioner submits that cash security may be imposed on him.

Considering the submissions made by learned counsel for the parties, it is directed that the cash security of Rs.3,000/-(rupees three thousand) be deposited in the name of the learned court below. It is further directed that in 7th line of paragraph-5 of the order dated 01.08.2022 "on verification of criminal antecedents of similar nature" be waived, rest part of the order shall remain intact. 7.
Four weeks' further time from today is extended for the petitioner to surrender before the learned court below, vide order dated 01.08.2022 passed in ABLAPL No.8758 of 2022, but subject to depositing cost of Rs.500/- (Rupees five hundred) in the Advocates' Welfare Fund of Orissa High Court Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit. 8.
It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.
