Mohanty, learned Counsel for the Respondents files memo in Court today, which is taken on record.

Miss Mamata Mishra, learned Counsel for the Appellants and Mr. P.K. Mohanty, learned Counsel for the Respondents being present in Court submit in chorus that the parties have amicably resolved the dispute giving rise to this litigation and they have arrived at a compromise/settlement as has been indicated in paragraph-5 of the Application dated 15.02.2022. They submit that the parties having dictated the terms and conditions of the compromise; the Application has been prepared by reducing all those therein and they having read the same and found the contents to have been correctly written have signed thereon and sworn affidavits. They also

// 2 // submit that the compromise so arrived at by the parties is lawful. They thus pray for disposal of the Appeal in terms of compromise arrived at by the parties.

Keeping in view the submissions made, I have gone through Application filed on 15.02.2022. The parties have signed on the Application which is supported by affidavits. Miss Mishra and Mr. Mohanty learned Counsels have identified the signatures of their respective clients. The judgments passed by the Courts below as also compromise Application being gone through; this Court finds no such reason to say that the compromise is not lawful, when no such other impediment also surfaces on the way of acceptance of the compromise.

In the above premises, this Appeal stands disposed of in terms of compromise. The compromise Application shall form part of the decree.

Issue urgent certified copy as per rules.
