From the submission of learned counsel appearing for the petitioner, this Court finds, in the first step this very petitioner has taken a direction for admission of R.P.No.591 of 2021, a proceeding under Section 15(b) of the Survey & Settlement Act pending before the Commissioner, Land Records and Settlement, Odisha, Cuttack. Taking this Court to the pleading herein, learned counsel for the petitioner alleges that even pendency of 15(b) proceeding, the Government is proceeding with road construction over the land over which the petitioner is claiming his right, title and interest and pending before the competent authority. In the above situation, this Court opines, it is better for the petitioner to raise objection before the Competent Authority for their consideration. Under the circumstance, this Court finds if the petitioner is so advised may make an approach by way of objection to the competent authority within reasonable period of time.
