1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 21st March, 2022 in connection with Anandapur P.S.

Case No.30/2022 corresponding to Special Case No.15/2022 pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Keonjhar for the alleged commission of the offence under Sections 376(3)/354-A/354/506/34 of I.P.C. and Sections 4 o and 12 of the POCSO Act.

4. Considering the submissions and the materials on record, I am not inclined to allow the prayer for regular bail, which is therefore rejected. However, considering that fact that the victim has already been examined and looking into the advance age of the Petitioner, learned court below is directed to release the Petitioner on interim bail for a period of one month from the date of his actual release on such terms and conditions as may be fixed by the court in seisin over the matter including the condition that he shall not misuse the liberty granted to him.

5. After expiry of the aforesaid period of one month, the Petitioner shall surrender before the court in seisin over the matter, failing which appropriate warrant may be issued for his production.

6. Urgent certified copy of this order be granted on proper application.
